Terms of Service
These Terms govern access to and use of Post Engine, available at https://post-engine.io (the “Service”). The Service is operated by Gameaton (“we”, “us”, “our”). By creating an account, connecting a social platform, or otherwise using the Service, you agree to these Terms and to our Privacy Policy.
1. Who we are
Post Engine is a self-hosted social media scheduling, publishing and collaboration tool. It is based on the open-source Postiz software, configured and operated by Gameaton for Gameaton’s own use and for users we expressly invite. Contact: sp@gameaton.com.
2. Eligibility and accounts
- You must be at least 16 years old and able to enter a binding contract.
- Registration is restricted. Access is by invitation or by an existing authorised account. You may not create an account unless we have authorised you to do so.
- You are responsible for your credentials, for activity under your account, and for keeping connected platform tokens secure. Notify us promptly if you suspect unauthorised access.
3. The Service
The Service lets authorised users draft, schedule, publish, and manage content on third-party social platforms they connect (which may include Meta services such as Facebook, Instagram and Threads, X, YouTube, TikTok, LinkedIn, and other integrations we enable). Features may also include media upload, team workspaces, analytics derived from connected accounts, and optional AI-assisted drafting.
We may change, suspend, or discontinue features. The Service is provided for operational use and is not a consumer mass-market product. We do not guarantee uninterrupted availability, specific publishing times, or that a third-party platform will accept a given post.
4. Your content and connected platforms
- You retain all rights in content you submit (text, images, video, captions, metadata).
- You grant us a limited licence to host, process, transmit, transcode, and publish that content solely to operate the Service and to carry out the actions you request (including publishing to platforms you connect).
- When you connect a platform, you authorise us to obtain and use the access tokens, permissions and data that platform provides so we can act on your behalf (for example to upload media, create posts, read basic profile or page information, and retrieve delivery status).
- Each connected platform has its own terms. You must comply with them. We are not those platforms and we do not control their APIs, moderation, rate limits, or account enforcement.
- You represent that you have all rights and consents needed for the content you publish, including music, likenesses, trademarks, and personal data of others.
5. Acceptable use
You may not use the Service to:
- violate law, these Terms, or a connected platform’s rules;
- infringe intellectual property, privacy, or publicity rights;
- upload malware, scrape the Service, probe or attack infrastructure, or circumvent access controls;
- spam, impersonate others, or run undisclosed automated engagement schemes;
- publish sexual content involving minors, or any other illegal content;
- attempt to access another user’s workspace without authorisation.
We may suspend or terminate access, remove content from our systems, and disconnect integrations if we reasonably believe you have breached these Terms or created a security or legal risk.
6. AI-assisted features
Optional AI features may generate or rewrite captions and related suggestions. Outputs can be inaccurate or unsuitable. You remain solely responsible for reviewing, editing, and publishing any AI-assisted content. Do not submit confidential information to AI features unless you accept that it may be processed by our subprocessors to generate the response.
7. Fees
Unless we agree otherwise in writing, access to this instance is not sold as a paid subscription. You remain responsible for any fees charged by connected platforms, bandwidth, or third-party tools you use alongside the Service.
8. Intellectual property
The Service, its branding (“Post Engine”), and our configuration remain ours or our licensors’. Postiz is open-source software licensed by its authors; these Terms do not grant you extra rights in that software. You may not copy, reverse engineer (except where mandatory law allows), or resell the Service.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that posts will be delivered, that analytics are complete, or that third-party APIs will remain available or compatible.
10. Liability
To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost goodwill, arising from the Service or from a connected platform. Our aggregate liability arising out of these Terms is limited to EUR 100, or, if you paid us fees for the Service in the 12 months before the claim, the amount of those fees. Nothing in these Terms excludes liability that cannot be excluded under French law, including liability for death or personal injury caused by negligence, or for fraud.
11. Indemnity
You will indemnify Gameaton against claims, damages, and reasonable legal costs arising from your content, your use of connected platforms, or your breach of these Terms, except to the extent caused by our wilful misconduct.
12. Termination
You may stop using the Service and ask us to close your account at any time by emailing sp@gameaton.com. We may suspend or close accounts as described above. After termination we may delete your local data in line with the Privacy Policy. Content already published on third-party platforms remains subject to those platforms’ rules and is not automatically deleted by us.
13. Changes
We may update these Terms. The “Last updated” date will change, and the new version will be posted at https://post-engine.io/terms-of-service. Continued use after the effective date constitutes acceptance, except where applicable law requires a different process.
14. Governing law
These Terms are governed by the laws of France, without regard to conflict-of-law rules. Courts located in France have exclusive jurisdiction, subject to any mandatory consumer protections that apply to you.
